Resolved Question: I don’t know what to do?
My town has a leash law.A couple times my dog has broken her leash and got off and the police came and told us that we had to keep her on one.Well we finally got a leash and collar that she can’t get off of.Well There is this little girl that lives up the road.She is a brat.Hits my daughters and her mom does not supervise her at all(she is 7).3 days ago I told her she was not aloud at our house anymore.Today we were gone almost all day.Well we came home and my neighbors came out and said they were just getting back from the lake and inside and heared a blood curdling scream and looked out and it was the little girls running from our house.They figured she had got bitten by our dog.Well the next thing they knew there was 5 cops at our house and they were holding tazers trying to get out dog out from under our porch(on her leash).The little girl I guess was taken by ambulance to the hospital.So my husband went to the police station and they could not tell us anything that happened other than a child had been bitten, and that our dog was being quarantined for 10 days and we got a vicious dog citation.Well we were looking outside and they took her chain,collar and all.They won’t let us see our dog until Monday.Mind you that our dog has NEVER been aggressive toward children.We have 4 and the little girl used to come to our house all the time and even show up at 9pm and walk up to the door with the dog licking her.(our dog is an Austalian Shepherd.) so not even a big dog.My MIL and FIL went up to talk to the police and to get the collar and leash and I guess the little girl had a small puncture wound.Well while we were standing outside waiting for them to get back the little girl rides her bike down to our house(we live on a dead end street with like 5 houses on it)Its dark out and nobody once again is even out there.We called and got a family lawyer tonight and will discuss stuff with him next week.I think they will probably try to sue us.Missouri from what I have read is a “one bite” state meaning usually your not liable if its the first time your dog has bitten and you have no reason to think that your dog would attack somebody.The thing is we were following the law by having our dog on the leash and we were not home which was clear(our vehicle was gone).She should not have been at our door anyway.1) we were not home 2) she was told not to be at our house.I am sooo mad right now.Im mad that our family pet is gone and my little girls are so upset and keep asking where Lucy is and why she is gone.They have been crying since we got home.Anyone else have anything similar happen?Am I right that she was tresspassing.We didn’t invite her on the property,my dog was not running loose(I was abbiding the leash law) and we were not even home.
oh and at the end of our walk there was a huge pile of blood MIL asked about it and they said the dog catcher cut her mouth open capturing her but my neighbors say they(cops) were screaming,taking pictures,holding tazers at her and kicking her trying to get her from under the porch.
she is the front yard.We have a covered front porch and she wont go in her dog house so we keep her up there so she can get on the porch when its raining etc.Plus 3 nights ago we caught someone trying to break into our truck so we are glad she was up there.She is very territorial(that breed it) and barks when people are messing around to warn us
no and acutally I am thinking about reporting the mom to DFS.She has her 13 year old son superivise the girl all the time.One Time my daughter was hit by a stick by the girl and was bleeding screaming in front of their house(I was in my house feeding my 5 month old twins)and the mom didn’t even come out to see what was wrong I heared it and walked 3 houses down and got on to the girl and brought my 4 year old home.It doesn’t make since that the girl can come to my door at night with us home to see if my girls can play and I tell her they are in bed(its 9pm) and she doesn’t get bitten.I bet anything the dog jumped on her to say hi and she took off running or hit the dog,The little girls shoe was still in our yard.
for her being so hurt they took her by ambulance it was kinda funny the little girl was out riding her bike.We did take a picture of that.I do let my children play outside but they always ask if they can go to her house and I know where they are.Her mom don’t half time time.The thing is they just moved in and bought their house like a month ago and seems like they have been nothing but trouble since.And from what us and my neighbors have said they aren’t very welcome.Everyone is upset about the dog.I guess my neighbors gave the cops a mouthful.Should I go talk to the mother and ask what happened and explain that I have told the little girl NOT to come to our house and that we were not even home all day?
we walk her everyday and let her run in the back yard for a few hours in the morning and evening with us out there everyday(we just can’t keep her in the backyard because she jumps the fence if we aren’t out there)I feel bad chaining her but she does get lots of attention.She is like another child
Voting Question: How do I file a defamation/slander suit and what do I ask for?
I have been having trouble over the past few years from one of my neighbors. Long story – I bought my home in a small lake community in rural Missouri 6 years ago. I am a hispanic single mom with 2 kids from Dallas Texas, we are the only non-white family in the community. When we moved we also brought along our new born pit bull puppy. Over the years we have lived here, this one neighbor has been harassing us by calling the cops on anything he can possibly think of most of which was nothing at all (grass was over 5 inches tall in places, my RV was blocking his view of the lake – from 2 houses away, I had too many cars in my driveway – my bf is a mechanic) now things are getting worse, last year someone tried to break into my house and left the sliding glass door open and my pit (indoor dog) got out (probably what scared the burglar away) so he jumped at the chance to call the police claiming vicious and aggressive animals were running the streets, this got my pit of 5yrs at the time shot, luckily she lived – and NO she is not mean in any way. Recently my new roommate let the dogs out in the back yard to get some sun so he called the cops because my dogs were loose in my own backyard (he said he was scared to mow his grass) they took them in and now they want to put them to sleep because it has become a problem. NOW this guy is going around telling the neighbors that I’m running a drug house. He even went as far as to tell a friend parked in my drive way that he was writing down all the cars license plate numbers and the times they arrive and leave so he can turn us in as a drug house, so I called the cops on him. They went to him and threatened to take him to jail if he stepped on my property again, so his new move is to go door to door to neighbor’s houses trying to get them to sign some petition stating that they think im running a drug house too, some have signed just based on his word. I dont know what to do anymore, I was told I could file a civil suit but I don’t know how or what to ask for. Can anyone help? This is getting ridiculous!
To the responder about the “dogs” and “cars” our puppy grew up and yes we did take in a 3 legged stray about 2 years ago so we had 2 dogs. We do have several cars, a truck, a van, & an rv, a car trailer, & the kids have 4 wheelers (this IS rural missouri & a lake property). But 4 adults & 2 children (myself, my 2 fem roomies and ones bf, & my 2 kids) live here, I drive 70 miles back & forth to work so I also have a backup vehicle, they are older cars (80’s and 90’s) that need work from time to time. They are all tagged, insured, & legal…. what I really need to know is what kind of lawyer handles this type of suit & second what am I asking for? I just want him to quit harassing my family & friends & to quit trying to get all my neighbors to hate me, if he would just take back what he said about us I would feel better. As it stands now, if my coworkers hear this(I work as an accountant at a school) & schoolmates(I also go to school full time) it could jepordize my integrity at work.

where in missouri, tennessee or somewhere in the midwest, can you get a HUGE house with your own lake and acres of land? i couldnt find any on lake of the ozarks. thanks.
